General
These terms and conditions apply to Nero Global’s (“Nero”) Refer a Friend program (“Program”). By referring someone to Nero, or being someone who was referred to Nero, or otherwise participating in the Program, you agree to be bound by these terms and conditions and the Nero Privacy Policy. The Privacy Policy is available at neroglobal.com/privacy.
Program Participation and Eligibility
The Program is only available to those who have an existing relationship with Nero (excluding Nero Sales Employees) and the businesses they refer to Nero. Nero reserves the right to modify, extend or cancel this Program at any time. Individuals who have an existing relationship with Nero that initiate a referral, are defined as “Referrers”. Non-customers who become a Nero customer upon a referral are defined as “Referees.” Eligible Referrals: The Program is only available for individuals who have an existing relationship with Nero (excluding Nero Sales Employees). To make referrals, you must: o agree to only refer those whom you have a personal or professional relationship with; o fill out the referral web form by providing your name and email address, and the name, email address and contact number of the person you are referring. Participation in the Program is prohibited where void by applicable law or regulation. The Program is only available through . You cannot earn a referral reward for referring someone who is already a Nero customer, or for referring yourself. If the person you have referred has already become a Nero Global customer, prior to the inception of this program, they will not be able to claim that they were referred and neither you nor them will receive a reward for the referral. Ineligible Referrals: Nero reserves the right to void any referral reward based on the following: (1) ineligibility of any Program participant, (2) fraudulent activity or, (3) if Nero, in its sole discretion, finds that you have violated any of the Program Terms and Conditions. Eligible Referees: You cannot receive rewards for referring yourself or by adding additional beacons under your existing account. You can only accept one referral; you cannot accept a referral from more than one person. You will not receive any referral rewards if you fail to comply with any of the terms of the Program.
Reward Redemption
Referral rewards are non-transferable, non-assignable, and cannot be redeemed or exchanged for cash, credit or other merchandise outside of the Program.
Additional Terms and Conditions
Tax: You are responsible for any and all tax liabilities associated with the Program. Void Where Prohibited: This Program is void where prohibited by law. We reserve the right to change the terms and conditions of the Nero Refer a Friend Program at any time, without notice, at our sole discretion. We reserve the right to not award a reward or disqualify someone from the Program if we feel, in our sole discretion, that fraudulent behavior or other unethical conduct has occurred in any way that compromises the fairness of the Program in any way. Rewards cannot be combined with other promotions and are not valid for previous offers or orders. Spam, unsolicited commercial email, or any form of illegal means of communication is illegal, prohibited, and will be grounds for termination of your participation in this Program. Fraudulent or unethical means of communication such as using bots, fictitious identities, fake emails, or scripts is also prohibited and will result in similar actions by us with respect to terminating your participation in the Program. Nero Global Tracking services are subject to additional terms, conditions, and other restrictions. By participating in this Program, you agree to release and hold harmless us and RewardStream Inc., as the operator of the Program for us and their affiliates and subsidiaries, directors, officers, employees, consultants, and agents, and any other entity associated with marketing this Program (collectively, the “Released Parties”) from any and all claims or damages arising out of, or in connection with the Program. You further agree that the Program and rewards are provided “as is where is”. THERE ARE NO REPRESENTATIONS OR WARRANTIES INCLUDING BUT NOT LIMITED TO STATUTORY WARRANTIES AND CONDITIONS, WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, THIRD PARTIES RIGHTS, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. IN NO EVENT WILL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF ONE PARTY HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.
